The purpose of the general terms and conditions of sale is, on the one hand, to inform any consumer as to the terms and conditions under which the seller sells and delivers the products ordered and, on the other hand, to define the rights and obligations of the parties in connection with the sale of the products by the seller to the consumer.

They apply, without restriction or reservation, to all sales by TISSUS PRICE of the products offered on its website.

Consequently, the fact that any person orders a product offered for sale on the TISSUS PRICE website implies full acceptance of these general terms and conditions of sale which the Customer acknowledges to have read before his order.

Products are offered for sale on the following geographical territory: Metropolitan France. The Customer, prior to ordering, declares:

• Whether the purchase of products on the TISSUS PRICE website is limited to personal or professional use.
• Have full legal capacity, enabling it to engage under these general terms and conditions of sale.

The Customer does his personal business of setting up the computer and telecommunications means allowing access to the Site of TISSUS PRICE.

The Customer shall retain the costs of telecommunications when accessing the Internet and using the website.

4.1. Rates

The selling prices of the online products on TISSUS PRICE's website, shown in euros, are those in force at the time of registration of the order form by the Customer.

They do not include shipping costs, invoiced in addition to the price of products purchased according to the weight in kilograms of the order.

Shipping costs will be indicated before the Customer registers his order by the Customer.

Prices include the value added tax (VAT) applicable on the day of the order and any change in the applicable rate will automatically be passed on to the price of the products sold by TISSUS PRICE on its website.

The rates on our website are subject to change.

Until the formation of its order, any buyer can avail himself of the prices charged on our site.

4.2. Product characteristics

The characteristics of each of the products sold on our site are presented on this site. The colours of the products that are displayed on our site cannot be guaranteed, due to the ability of computer systems to solve images. In addition, a reassorted color can have a different rendering depending on the baths and arrivals.

Nevertheless, the Customer has a right of withdrawal under the conditions set out below.

All our products are intended to satisfy the characteristics that the Customer can expect depending on their nature and function.

No special need may be taken into account unless it has been the subject of an express agreement.

Moreover, our products often have several images including a mockup. This mockup allows to put the product in a situation in order to have a more precise idea of what your product will look like once sewn. However, the latter has a non-contractual value and does not reflect the exact reality.

4.3. Product availability

Our products can be sold within the limits of available stocks.

If despite the formation of an order, a product was unavailable, the sale will be resolved, and any amount paid by the Customer will be returned as soon as possible, and no later than 30 days.

For products not stored in its warehouses, TISSUS PRICE offers are valid subject to availability from its suppliers.

TISSUS PRICE reserves the right to modify the product range in the light of the constraints of its suppliers.

4.4. Unit and minimum purchase quantity

Products sold on TISSUS PRICE's website are sold either on a linear or a unit basis.

The minimum purchase for products sold per linear metre is half a metre. For certain products, Price Fabrics reserves the right to change the minimum purchase to one meter. Beyond the minimum purchase, it is possible to order in 0.5m.

In the case of products sold individually, the minimum purchase is 1 unit. In addition to 1 unit, it is possible to order per 1 unit.

4.5. Command

Any order will result in full adherence to these general conditions of sale.

From the moment the Customer has registered his order by clicking on the "Order" icon, he is considered to have accepted without reservation the present general conditions of sale, the prices, volumes and quantities of the products offered for sale and ordered.

However, the Customer may cancel his order within one hour of his validation. The sale will not be considered final until the Customer has been sent confirmation of the order by TISSUS PRICE and has received the full price.

TISSUS PRICE recommends that the Customer keep this information on a paper or computer document.

4.6. Electronic validity

The online provision of the Customer's credit card number and the final validation of the order will be proof of the Customer's agreement in accordance with the provisions of the law of 13 March 2000 and will be worth:
- the amount due for the purchase order,
- signature and express acceptance of all transactions carried out.

In the event of fraudulent use of the credit card, the Customer is invited to contact his or her account content.

Payment must be made when ordering by the Customer. At no time shall the sums paid be considered as deposit or advance payments.

All orders are payable in euros.

To adjust its order, the Customer has the following methods of payment :

• Bank card
• Paypal
• Cheque (Payment by cheque is limited to 500€. For an order in excess of €500, bank cheques are accepted. To do this, select "bank transfer" at the time of payment.)
  
• Bank transfer

For any payment by transfer or cheque, the stock is not reserved.

For any payment by cheque, you have 15 days to send it.

TISSUS PRICE reserves the right to suspend any order and/or delivery, whatever the nature and timing of the decision, if a default in the payment system appears, and/or if the payment cannot be made by this system, because of the non-existence or unavailability of the price which should be sent to it at the order.

However, if the sale is made, and for one cause or another, the settlement has not been made, TISSUS PRICE reserves the right to request a resolution.

On the other hand, under this reservation, all sums due to it will yield interest at the legal rate plus five points running from the date of the contract until payment.

The delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions of this Agreement.

As part of the fight against Internet fraud, your order information can be sent to any third party for verification.

6.1. General rules

You have the choice between Delivery to Home, Pick-Up Place, Proximity Trade and Post Office.

Shipping costs are borne by the Customer. The calculation of shipping costs shall be carried out in proportion to the total weight of the item(s) ordered.

By default, invoices are sent to the email address indicated by the Customer upon registration.

In the absence of compliance with the procedures set out below, no customer complaint will be accepted.

The Customer must show up at the latest 48 hours (working days from the day after delivery) to TISSUS PRICE by email accompanied by any proof (photo, written) at contact@tissusprice.com.

6.2. Characteristics of the Colissimo system Monitoring the POST

The Customer is delivered to his home by his factor within 96 working hours and signs a delivery slip acknowledgement of receipt.

In the event of absence, the Customer or the recipient of the product ordered shall receive a notice of passage of his factor, allowing him to withdraw the products ordered, at the nearest post office, for a period of fifteen days.

The Customer is required to verify, in the presence of the postal or delivery agent, the condition of the packaging of the goods and its contents upon delivery.

In the event that the Customer has any doubt of any kind about the condition or contents of his package, he is bound:

• apply the Colissimo procedure (in particular to report damages due, any claims and reservations) and refuse the goods by immediately issuing an anomaly to the post office official;
• to report these incidents to BOUTIQUE TISSUS PRICE by email to contact@tissusprice.com.

All the general conditions of the Colissimo Post Tracking system are available on the website www.colissimo.fr.

6.3. Characteristics of the DPD delivery system

The Customer is delivered to his home via the DPD delivery system within 48 hours. The Customer is obliged to check, in the presence of the delivery agent, the condition of the packaging of the goods and its contents upon delivery. In the event that the Customer has any doubt of any kind about the condition or contents of the package several hours after delivery. All the general conditions of the DPD France system are available on the website www.dpd.com.

Warning: Delivery time = Order preparation + Transport

If the deadline expires on a Saturday, a Sunday, a holiday or an unemployed day, it shall be carried over to the next working day.

The delivery time will be increased in the event of a strike, whether general or special, whether it concerns the seller and/or its suppliers.

It will also be increased in the event of impossibility to deliver, in particular as a result of weather or in the event of force majeure.

If the delivery is not made within seven days of the deadline set above, the Customer may denounce the sale by registered letter with acknowledgement of receipt, unless delivery occurs before this letter is received by the seller.

The right to request the termination of the contract may be exercised within 60 working days of the date indicated for the delivery of the property.

For all motifs printed on our premises, delivery can be extended from 6 to 7 working days.

The loyalty card is part of the Fabrics Price loyalty program. It is free, nominative, personal and limited to one per natural person.

The pool cannot be sold or exchanged for cash.

7.1. Withdrawal/loss/theft

• Withdrawal of the card

Fabrics Price reserves the right to terminate the holder's loyalty card at any time in case of fraudulent use of the card for any legitimate reason.

• Loss or theft

In case of loss or theft, the holder will have to pay €5 for printing a new card.

7.2. Program amendment/suspension/closure

Price Fabrics reserves the right to modify at any time these terms and conditions which remain accessible to customers on the site https://www.tissus-price.com/en/.

Price fabrics reserves the right to suspend or terminate the program at any time.

The announcement of the suspension or closure of the programme will be made by the dissemination of information by the most appropriate means (mail, email, SMS, posting on the website...).

No customer will be able to appeal against Fabrics Price for any reason.

No modification or deletion will entitle the client to compensation.

7.3. Liability

Price fabrics is exempt from any liability for the direct or indirect consequences of any anomalies and malfunctions of the loyalty card, whatever their causes. In the event of a dispute, only the information contained in the Price Fabrics database will be authentic.

7.4. Computers and freedoms

The information collected is processed electronically to inform you of the store's business and current affairs. The recipients of the data are Price Fabrics only. You may also, for legitimate reasons, oppose the processing of your data.

You have 14 days from the receipt of your products to exercise your right of withdrawal, without having to justify any reason. However, in order for you to benefit from this right products must be returned in their original state : not cut, not washed and in their original packaging (if applicable).

How can you exercise your right of withdrawal?

1. Notification : You must notify us of your withdrawal decision before the end of the 14 day period. You can contact us by email via our contact form, by phone at 04 22 14 50 00, or by post at the following address:

2. Return of products : Once your withdrawal is notified, you must return the products within 14 days. Return expenses are at your expense. Products must be in their original condition, unused, and not modified.

3. Refund : Upon receipt of returned products, we will make your refund within 14 days. The refund will be made using the same payment method as used during your order, unless otherwise agreed.

Exceptions to the right of withdrawal

The right of withdrawal shall not apply in the following cases:

• The coupons : These products are sold with a visible defect and cannot be returned because they are sold at a reduced price to avoid wastage.

• Products deteriorating quickly or personalized according to your specifications.

• All products already used, cut or washed.

Defective products

If you receive a defective or damaged product, you have up to 30 days after reception to contact us. In this case, you can request an exchange or a full refund, provided the product is in the same condition as at the reception (uncut, unwashed).

TISSUS PRICE retains full ownership of the products sold until the price is fully collected, in principal, including fees and taxes.

10.1. Compliance

The TISSUS PRICE BOUTIQUE guarantees the conformity of products, subject to the above reservations, under the conditions laid down in the Consumer Code.

10.2. Hidden vices

Products sold benefit from the legal guarantee of hidden defects.

TISSUS PRICE may not be held liable for failure to perform the contract in the event of stock failure or unavailability of the product as a result of a case of force majeure, disturbance or strike, in particular postal services and means of transport and/or communications.

TISSUS PRICE cannot be held liable for any indirect damages that may arise as a result of the purchase and delivery of the products.

TISSUS PRICE cannot be responsible for any loss of data, files. It is the responsibility of the Client to perform all necessary backups.

The TISSUS PRICE website also contains information from third parties and links to other websites.

TISSUS PRICE may in no case be held liable for damages resulting from the use, access to, or inability to use such third party information, or the content of other websites.

The TISSUS PRICE warranty is limited to the value of the purchased products.

When you order products on TISSUS PRICE to be delivered outside the European Union, you may be subject to import obligations and taxes, which are collected when the package arrives at its destination. Any additional customs clearance costs will be borne by you; we have no control over these costs. Customs policies vary greatly from country to country, so you should contact the local customs service for more information. Please note that when placing an order on Amazon, you are considered the official importer and must comply with all laws and regulations of the country in which you receive the products. Protecting your privacy is important to us and we draw the attention of our international customers to the fact that cross-border deliveries are likely to be opened and inspected by customs authorities.

TISSUS PRICE reserves the right to make changes to its Website, procedures, and terms and conditions, including these Terms and Conditions of Sale at any time. You are subject to the terms and conditions, procedures and General Conditions of Sale in force at the time you order a Product, unless a change to these terms and conditions, or these General Conditions of Sale is required by an administrative or governmental authority (in this case, this change may apply to previous orders you have made). If any of the provisions of these General Conditions of Sale are deemed invalid, invalid or inapplicable, whatever the reason, this provision shall be deemed divisible and shall not affect the validity and effectiveness of the remaining provisions.

Specifically, they are considered to be cases of force majeure or fortuitous, in addition to those usually retained by the case law of French courts and tribunals: blocking of means of transport or supply, earthquakes, fires, storms, floods, lightning, stopping telecommunications networks or difficulties specific to telecommunications networks external to customers.

The parties will come closer to examine the impact of the event and agree on the conditions under which performance of the contract will be continued. If the case of a major force exceeds three months, these general conditions may be terminated by the injured party.

Sales of TISSUS PRICE products are subject to French law. Any dispute relating to the interpretation, performance or breach of the contract concluded between TISSUS PRICE and the Customer, even in the case of multiple defendants, shall, in the absence of an amicable agreement, be subject to the exclusive jurisdiction of the TOULON courts or the court of the place of delivery of the property except where the Customer is a consumer within the meaning of the texts in force.

The information collected by TISSUS PRICE when ordering from the Customer is necessary for the management of its order by TISSUS PRICE

In accordance with the law "Informatique et Libertés" n° 78-17 of 6 January 1978, the Customer has a right of access, rectification, opposition and deletion of the data concerning him with TISSUS PRICE.

Through TISSUS PRICE, the Customer agrees to be informed of TISSUS PRICE offers.

If the Customer wishes to receive these proposals more, he can inform TISSUS PRICE by mail or e-mail.

TISSUS PRICE reserves the right to install cookies in the computer of visitors to its website. A cookie does not allow us to identify you. In general, it stores information about your computer's browsing on our site that we can read on your subsequent visits.

Any submission of content in violation of these principles may result in sanctions, including suspension of your account and potential legal proceedings.

These conditions apply to all customizations and any sending of files via our custom product platform. We encourage you to use only content you have created or for which you have the necessary rights.

Attention, a number of elements are likely to generate a different print rendering than that presented on our site; different from the one you have previously ordered; different from your sent file (when customizing).

The composition of the selected fabric, the colorimetry method chosen, and the digital printing process used, do not make it possible to affirm the accuracy of the rendering obtained during printing.

Thus, understand that all images displayed online are digital web renderings, which can in no way match the printing colors obtained.

Example 1 : If you ordered a Rabbit pattern on velvet fabric in July, and you want to recommend in August this same pattern, on the same fabric, and get the same rendering. We will not be able to guarantee the same result, because the printing may be different depending on the machine used, for example.

Example 2 : If you ordered a Rabbit pattern on two different fabrics, the color rendering may be different. Indeed, color rendering can vary from one material to another.

Example 3 : If you ordered a Rabbit pattern that appears blue on the screen, it may be that when printing the same pattern the color varies. Indeed, the colors obtained on the screen and printing cannot correspond to 100%.

Thus, we strongly advise you to always order a free sample before placing your order.

The promotional codes offered by Price Fabrics are valid only under the specified conditions and for specified periods. They may not be combined with other offers or discounts unless otherwise specified. Their use is subject to specific criteria (product, minimum purchase amount, etc.) and must be made when ordering on the site.
